AI Legal Assistant Refund Policy

  1. Supplementary Terms

These terms and conditions (Refund Policy) apply in addition to, and form part of, our Terms of Service. If there is any inconsistency between our Terms of Service and this Refund Policy, this Refund Policy will prevail to the extent of the inconsistency. Capitalised terms which are defined in our Terms of Service have the same meaning in this Refund Policy.

  1. No refunds

To the greatest extent permitted by law (including the Australian Consumer Law, if applicable), unless otherwise expressly stated by us, all fees and other monies payable by you to us are non-refundable immediately upon payment by you.

We may, in our discretion, where we consider it appropriate to do so in the circumstances:

  • partially or fully refund one or more payments made by you;
  • provide you with an account credit; or
  • provide you with a non-monetary benefit, such as access to services offered by us, or access to paid features of our Services.

You must honour any minimum subscription period you commit to under your subscription type or plan. If you notify us of your intention to cancel your subscription, we will cancel it at the end of your minimum subscription period and all fees for the balance of your subscription period will remain payable. You will retain access to our Services until the end of your subscription period.

  1. Plan or subscription changes

To the greatest extent permitted by law (including the Australian Consumer Law, if applicable), unless otherwise expressly stated by us, we have no obligation to agree to any request by you to change or modify plans, subscriptions, or fee arrangements, during any minimum contract period term that you have agreed to (e.g. 12-month commitment terms).

Where you request a change of your plan, subscription, or fee arrangement, we may in our discretion agree to offer a refund or modification to your existing arrangements, however, we reserve the right to deduct any fees that we incur as a consequence, including but not limited to merchant fees and other fees charged by third party payment processors.

  1. Chargebacks and reversed transactions

If you initiate a transfer recall or reverse transaction with your financial institution, or a chargeback on your credit or debit card, or take any similar action, you must pay us an administration fee of AUD $50.00 on demand.

If you initiate a transfer recall or reverse transaction with your financial institution for your subscription fees, each onboarding and private training session attended by you will be charged to you at $300 plus GST per session (Training Costs). You authorise us to charge all administration fees and Training Costs to your method of payment. We will otherwise invoice you for such amounts, with payment due within seven (7) days of invoice.

You acknowledge, agree and consent to us setting off any such fees and costs against any monies which we may owe to you from time to time.

You agree to indemnify us for any legal and other costs incurred by us in disputing any improper transfer recall or reversed transaction initiated by you with your financial institution.

  1. Suspension or termination of your account

Where we alter or delete your user account, or suspend or terminate your access to our Services, due to your breach of our Terms of Service, or your breach of the law, or where we consider it necessary to do so for health, safety or legal reasons, we will not refund you any fees paid by you prior to the date of alteration, deletion, suspension or termination (as the case may be) and you must honour any minimum subscription period you have committed to under your subscription type or plan.

  1. Force majeure events

If your access to your account or our Services is impacted due to any event that is outside our reasonable control and could not have been prevented by us taking reasonable steps (Force Majeure Event), you will not be entitled to any refund of fees paid by you for the period during which any such Force Majeure Event is ongoing.

  1. Disputes

Except as permitted by law, in the event of a dispute between you and us, or between you and any other person using our Services, you must:

  • notify us of the dispute by using the contact facility on our Site;
  • provide us with full and complete details of the dispute;
  • providing such supporting information or documents as we reasonably request; and
  • act reasonably and in good faith with the other parties to the dispute in order to resolve the dispute amicably without formal legal action.
